Delivery Terms

DELIVERY TERMS These Delivery Terms govern the delivery of goods purchased through the Vinařství Hnidák online shop and supplement the Terms and Conditions of the online shop. Seller: Jaromír Hnidák Nová 97, Josefov, 696 21 IČO: 72517816 DIČ: CZ5605311965 E-mail: info@vinarstvihnidak.cz Phone: +420 608 376 123 (hereinafter referred to as the "Seller") 1. Delivery Methods We deliver goods using delivery methods that are currently available in the online shop. Specific delivery options are displayed to the customer in the cart or during the ordering process. The availability of individual delivery methods may depend in particular on: the delivery location, the quantity and weight of ordered goods, the nature of the order, the possibility of safe transport of glass bottles, the ability to ensure an appropriate regime during the transport of alcoholic beverages. The Seller may restrict certain delivery methods for specific orders for safety, operational or legal reasons. 2. Delivery Price The delivery price is always displayed to the customer before binding submission of the order. Thus, before creating an order, the customer knows the price of the ordered goods as well as the price of the selected delivery method and any related paid services. For details about prices and payment methods, see the Prices and Payment Terms page. 3. Order Dispatch We dispatch the order after the conditions necessary for its dispatch have been met. For orders paid in advance, the shipment may be dispatched only after successful payment. After handing over the shipment to the carrier, the customer may receive information enabling shipment tracking, if the respective carrier provides this service. The estimated delivery time stated on the e-shop or in the order is indicative, unless expressly agreed otherwise. This does not affect the consumer's statutory rights in case of the Seller's delay in delivering goods. 4. Wine Packaging Wine is transported in glass bottles, and therefore we pay increased attention to safe packaging of shipments. We use shipping packaging and filling appropriate to the nature of the ordered goods and the selected delivery method. The Buyer is not entitled to request, without agreement with the Seller, a packaging method that, according to the Seller or the carrier, would not be suitable for safe transport. 5. Accuracy of Delivery Details The Buyer is obliged to provide correct and complete details necessary for delivery when ordering. We recommend checking the following before submitting the order: recipient's first and last name, delivery address, phone number, e-mail address, any other details required by the selected carrier. If the customer discovers an error after submitting the order, they should contact us as soon as possible at: info@vinarstvihnidak.cz +420 608 376 123 If the shipment has already been handed over to the carrier, changing the delivery details may not be possible. 6. Sale and Delivery of Alcohol – 18+ Only THE SALE OF ALCOHOLIC BEVERAGES TO PERSONS UNDER 18 YEARS OF AGE IS PROHIBITED. Orders containing alcoholic beverages may only be intended for persons over 18 years of age. The Buyer, when placing an order containing alcohol, confirms that: they have reached the age of 18, the details provided are truthful, the recipient of alcoholic beverages will not be a person under 18 years of age, they acknowledge the possibility of age verification upon collection. 7. Age Verification Upon Handover The Seller may use a delivery method enabling verification of the recipient's age. The recipient may be asked to present a valid document enabling age verification upon handover of the shipment. A shipment containing alcoholic beverages may not be handed over particularly if: the recipient has not reached the age of 18, the recipient refuses the required age verification, the recipient's age cannot be verified in a reasonable manner, a person under 18 years of age attempts to collect the shipment, the handover would be contrary to legal regulations. In such a case, the shipment may be returned to the Seller. 8. False Confirmation of Legal Age The Buyer is obliged to provide truthful information. False confirmation of age does not establish the right to handover of an alcoholic beverage. If the Buyer falsely confirms legal age, designates a minor as the recipient, refuses the agreed age verification or otherwise breaches their obligation and directly related to this the Seller incurs demonstrable costs or damage, the Seller may assert a corresponding claim to the extent permitted by legal regulations. This provision does not constitute a contractual penalty and does not limit the consumer's statutory rights. 9. Collection of Shipment The Buyer is obliged to provide reasonable cooperation necessary for proper delivery of the order. Mere non-collection of a shipment is not automatically a withdrawal from the contract. If the consumer wishes to exercise the right to withdraw from the contract, they must clearly notify the Seller of their decision in a manner corresponding to legal regulations. 10. Uncollected Shipments If the customer, without proper withdrawal from the contract or other legal reason, does not provide cooperation for collection of a properly ordered shipment and the Seller consequently incurs demonstrable costs or damage, the Seller may assert a corresponding statutory claim. The Seller may contact the customer after return of the shipment and offer re-dispatch. Re-dispatch may be conditional upon payment of new shipping costs by agreement with the customer. 11. Shipment Inspection Upon Collection We recommend checking the external condition of the shipping packaging upon collection. We particularly recommend paying attention to a shipment that is: significantly dented, torn, wet, deformed, opened, re-taped in a manner suggesting damage, or otherwise visibly damaged. If possible, we recommend reporting the damage to the carrier, having it recorded and taking photographs. Failure to inspect upon collection does not in itself deprive the consumer of their statutory rights arising from defective performance. 12. Broken or Damaged Bottle If you discover a broken or otherwise damaged bottle after opening the shipment, contact us as soon as possible: info@vinarstvihnidak.cz +420 608 376 123 For quick processing, we recommend sending: order number, photo of the shipping box, photo of the inner packaging, photo of the damaged bottle, photo of the label, if applicable, photo of the entire shipment. Detailed procedure can be found on the Complaints page. 13. Personal Collection If personal collection is currently enabled in the online shop, the conditions, location and any price will be stated in the ordering process. Also when personally collecting alcoholic beverages, the Seller is entitled to require verification that the recipient has reached the age of 18. If age cannot be verified, the alcoholic beverage will not be handed over. 14. Force Majeure and Extraordinary Circumstances Delivery time may be affected by circumstances that the Seller cannot reasonably influence, such as extraordinary traffic restrictions, extreme weather, failure of the transport network or other extraordinary events. In such a case, the Seller will proceed in accordance with legal regulations and will inform the customer as far as possible. 15.
